Acceptance of the terms

By accessing and using padelkiwi.com you accept these Terms of Service. If you don't agree, don't use the site.

These terms constitute a binding agreement between you (the user) and Padelkiwi, S.L. (hereinafter, "Padel Kiwi"). Use of the site implies full acceptance of the provisions established here in the version in force at any given time.

Use of the service

Padel Kiwi is an online store for padel-related products. We offer you access to the catalogue, the ability to buy, customer support and informational content about the sector.

Who can use the service

To browse the site you don't need to be of legal age. To make purchases you must be at least 18 years old (or legally emancipated) and have sufficient legal capacity. If you're between 14 and 17, you need parental or guardian consent to provide personal data.

How you can use it

You can use the site for personal, non-commercial purposes. Any commercial, automated, massive (scraping) use or one that harms the site's operation requires our express written authorisation.

User account and responsibility

You can buy as a guest or create an account. If you register, you're responsible for keeping your credentials confidential and for all activities that happen under your account.

Provide truthful, accurate and up-to-date information. You are solely responsible for any damage arising from false data.
Use a strong password and don't share it. Let us know about any unauthorised use of your account.
You can close your account at any time from your profile or by emailing us at contacto@padelkiwi.com.

Padel Kiwi may suspend or close your account if it detects misuse, breach of these terms or risk to the service. We'll notify you by email.

Content and services

We do everything possible to keep the site's information correct, current and complete. Even so, we can't guarantee the total absence of typos, omissions or occasional inaccuracies (price, stock, specs, etc.).

If you spot an obvious error that affects an order of yours, we'll let you know before processing it and you can cancel at no cost. Images are indicative and may have slight variations in colour or texture compared to the real product.

Real stock

Only products we physically have in stock appear as available. If you can't add an item to the cart, it's because there are no units at that moment.

Intellectual and industrial property

The website, its design, code, texts, images, logos and any other content are property of Padel Kiwi or have the licence or express authorisation of their owners.

The reproduction, distribution, transformation, dissemination or commercial use of the site or its contents, in whole or in part, is not permitted without our prior written authorisation. This includes automated scraping, massive capture of images/descriptions and reuse on comparators or other sites.

Brands, logos and trade names of products belong to their respective owners (manufacturers and suppliers) and are shown for descriptive purposes only. Padel Kiwi has the necessary authorisation to market the products it offers.

Unauthorised use of content may lead to the civil and/or criminal actions that correspond under current legislation.

Prohibited conduct

By using the site you commit to not engaging in any of the following conduct:

Introduce viruses, malware, malicious scripts or any element that could damage the site or other users.
Access or attempt to access restricted areas, other users' data or internal information without authorisation.
Reverse engineer, decompile or copy the technical operation of the site.
Bypass or attempt to bypass payment systems, coupons, promotions or any security measure.
Perform automated scraping, massive catalogue copying or use the site to train artificial intelligence systems without express permission.
Post false, offensive, illegal reviews or comments or any that infringe third-party rights.
Use the site to send unsolicited communications (spam) or for any unlawful purpose.

Padel Kiwi may deny or withdraw access to the site without prior notice to those who breach these rules, and reserves the right to report allegedly criminal conduct to the competent authorities.

Modifications and availability

Padel Kiwi may modify the site's content, prices, conditions and features at any time without prior notice. Publication on the site will be considered sufficient notification.

We do everything possible to keep the site accessible without interruption, but we can't guarantee the absence of technical incidents, server outages, external attacks or force-majeure events that may temporarily affect access. We are not responsible for damages arising from these interruptions.

Scheduled maintenance

We may carry out scheduled technical downtime for maintenance or improvements. When possible, we'll announce it in advance.

Limitation of liability

Within the limits permitted by applicable law, Padel Kiwi is not responsible for:

Indirect damages, loss of profits, data or opportunities arising from use of the site.
Damages caused by third parties (payment providers, couriers, social networks, linked sites).
Improper use of the site or products by the user.
Service outages, technical errors or external attacks beyond our reasonable control.
Content of third-party sites linked from our site.

Nothing in the above limits the rights consumer legislation gives you as a buyer, in particular the legal warranties on purchased products.

Applicable law and jurisdiction

These terms are governed by Spanish law. The drafting and interpretation language is Spanish; translations into other languages are offered for convenience, with the Spanish text prevailing in case of discrepancy.

For any controversy arising from use of the site, the parties expressly submit, with waiver of any other jurisdiction, to the competent Courts and Tribunals of Spain.

As required by European regulation, we inform you of the existence of a European platform for online dispute resolution available at ec.europa.eu/consumers/odr/.
