How we sell to you.
These conditions govern your purchase at padelkiwi.com: how to buy, payment methods, delivery times, prices and taxes, right of withdrawal and warranties.
Acceptance of the conditions
These conditions govern the use of the padelkiwi.com online store, legally owned by Padelkiwi, S.L. (hereinafter, "Padel Kiwi").
By accepting them, the user declares that they have read, understand and assume the obligations stated. If you don't agree with the content, you must leave this site and won't be able to access or use its services. The user expressly accepts that access to and use of the website is at their sole and exclusive responsibility.
These conditions are accepted without reservation, and may be modified at any time without notice; it is the user's responsibility to read them when making a purchase. The conditions in force at the time of contract conclusion apply.
Applicable law
This electronic contract is concluded under Spanish law, specifically under the legal regime imposed by Law 34/2002 (LSSICE) and Law 03/2014 (LGDCU).
Contract storage and reproduction
The electronic contract will not be archived by a third party and the language for its conclusion is Spanish. These conditions can be stored and reproduced at any time by the user making a purchase using browser options, and must be accepted before paying for the order.
User account and error correction
To make purchases you can register by creating a "user account", or do a quick checkout without registration (as a guest).
Guest checkout
If you check out as a guest, personal data will not be stored on the site nor will order history be available. Personal data is kept only for the management and delivery of the products ordered.
Checkout with account
If you choose to register, you'll receive a confirmation email and a reminder of your login details. From your account you can:
- Make purchases and check order history.
- Change the password and modify personal data.
- Modify shipping and billing addresses.
- Post comments and perform other actions related to your purchases.
Error correction
You can access your private account at any time to check personal information and correct any data entry errors. Shipping and billing addresses can also be corrected or updated throughout the purchase process.
Closing the account
You can close your account at any time by emailing, from the address you want to close, to contacto@padelkiwi.com, which will result in the cancellation of your personal data. Account creation and closure are governed by the Privacy Policy.
Purchase process
Buying at Padel Kiwi is easy:
Pick products
Click on each product to access its sheet with detailed description, specs and price. Images may show slight variations in colour or texture compared to the real product.
Add to cart
Click "Add to cart". You can keep adding products or go straight to checkout.
Order summary
A summary appears listing the selected items. To continue, click "Finish order".
Identify yourself
Register your details or continue as a guest. If you register, you won't need to enter your data again on future purchases.
Accept and pay
Accept the Sales Conditions and choose the payment method from those offered.
Confirmation
You'll receive an email with the purchase details and digital receipt. If you don't get it within 24h, contact us.
Paper invoice at no cost
If you haven't consented to receive the invoice electronically, you'll get a paper copy at no extra cost. You can withdraw consent at any time.
Payment methods
Padel Kiwi offers several payment methods. In all of them, Padel Kiwi never collects or handles any banking data: data is processed directly by the corresponding entity to provide maximum transparency, security and confidentiality.

Delivery times
The delivery time is shown during the purchase process and entails its acceptance by you.
If we don't deliver on time
You must give us an additional period appropriate to the circumstances that caused the initial delay. If we still can't deliver within that additional period, you may rescind the contract.
When the delivery time is essential given the circumstances or when you informed us before the purchase that delivery before a specific date is essential, you may rescind the contract immediately.
In any case, if the contract is rescinded, the amounts paid will be fully refunded.
Pre-order products
If you buy a product not yet on sale but with a launch date, shipping times are provisional and modifiable, subject to the number of units suppliers have at each moment. We'll contact you about variations and the option to rescind the contract.
Out of stock
In some cases, items may be out of stock. Our staff will contact you to provide a solution, inform you of the delivery time once available, or rescind the contract if you wish.
Prices, taxes, fees and duties
Prices are in euros. Padel Kiwi product prices may vary, but any changes won't affect orders for which a Shipping Confirmation has already been sent.
The final price may vary depending on applicable taxes in each case, or based on the shipping address and buyer profile (private or business).
Account closure, cancellation and blocking
User accounts are not deleted due to inactivity. The user can close their account by sending an email to contacto@padelkiwi.com or via the account profile.
In case of non-payment of an order, it may be temporarily suspended until the payment situation is resolved. After more than 15 days, Padel Kiwi may cancel it.
Padel Kiwi reserves the right to block access to the account without prior notice (or delete it) if used illegally or if obligations stated here are breached. Blocking or deletion does not affect the obligation to pay for products already purchased.
In exceptional cases, at the administrators' free discretion and assessing severity, they may opt to warn the offending user before permanently deleting or blocking their account.
Returns and withdrawal
You have 14 calendar days from receipt to exercise the right of withdrawal, plus Padel Kiwi's extended commercial policy of up to 30 days.
Wrong, defective or damaged product
Before opening the product, check the packaging matches what you ordered: colour, size, finish, etc. If the product was damaged in transit, let us know and, if possible, note the incident on the carrier's delivery note.
Products must be returned protected in an outer box or bag. Padel Kiwi provides a transport company to collect the goods completely free of charge.
Right of withdrawal
Under the LGDCU, and provided you are a buyer for private use, you have the Right of Withdrawal: you may return the product within a maximum of 14 calendar days from receipt, notifying us of your decision (you can use the model withdrawal form).

Conditions to return
To exercise this right, the product must be in perfect condition, preferably keeping the original packaging and all parts. If products don't arrive in perfect condition, don't include all parts and accessories, or don't retain the original packaging, Padel Kiwi reserves the right to refund a reduced amount.
Refund
The refund will be made after verifying the goods' condition, through the same payment method used at purchase, within a maximum of 14 calendar days from the proven receipt of the withdrawal request (provided Padel Kiwi handles the collection).
Return costs arising from exercising the right of withdrawal are at the buyer's expense.
Withdrawal exceptions
- Goods made to the consumer's specifications or clearly personalised.
- Sealed goods not suitable for return for health protection or hygiene reasons, once unsealed after delivery.

Warranties
Except for products excluded by their nature from warranty regulations, and provided the buyer uses them privately, all our products are warranted against manufacturing defects for 3 years from the purchase date (or delivery if later), or 1 year if the item is not new.
We will respond to non-conformities, which the buyer must report to us within two months of becoming aware of them.
Presumption of original defect
If the defect appears within the first 3 years from delivery, it is presumed to have already existed when the product was invoiced or delivered, unless we can prove the defect is not original (e.g. due to misuse or maintenance). After 3 years, that presumption no longer exists.
Solutions in case of defect
We may proceed, as appropriate, with repair, replacement, price reduction or contract termination. These actions will be completely free for the buyer (including transport costs, if any).
Warranty exclusions
- Defects due to external events, accidents or use not in accordance with our instructions or the manufacturer's.
- Normal wear.
- Products modified or repaired by the customer or an unauthorised person.
- Products subject to a specific contract.
Conformity with the contract
Unless proven otherwise, products are deemed conforming provided that:
- Match the description and have the qualities of the product presented to the consumer as sample or model.
- Are fit for the uses to which similar products are ordinarily put.
- Present the quality and performance usual for a product of the same type that the consumer may reasonably expect.
